This Data Deletion Agreement (“Agreement”) explains your rights and options for deleting your personal information from Legacy Keeper, operated by Traction Technologies Inc. (“Legacy Keeper,” “we,” “us,” or “our”). This Agreement is part of our broader Terms of Service and Privacy Policy.
IMPORTANT: Data deletion is permanent and irreversible. Please read this Agreement carefully before deleting your data.
1. Your Right to Delete Data
1.1 Immediate Deletion Right
You have the absolute right to delete all of your account data from Legacy Keeper at any time, for any reason, without needing to provide justification or explanation. This right applies to all users, including both Standard Users and Professional Users.
1.2 Self-Service Deletion
You can delete your data directly from your account settings page without needing to contact customer support or submit a deletion request. The deletion process is designed to be simple, immediate, and under your complete control.
1.3 No Fees or Penalties
There are no fees, charges, or penalties for deleting your data. If you have an active paid subscription, deleting your data does not entitle you to a refund for any remaining subscription period, but you will not be charged again after the current billing period ends.
2. What Gets Deleted
2.1 Complete Data Deletion
When you delete your account data, the following information is permanently removed:
- All estate planning information: Personal details, family information, asset details, beneficiary information, healthcare directives, and all other estate planning data
- All uploaded documents and files: Any documents, images, PDFs, or other files you have uploaded
- All AI-generated content: Documents, recommendations, and other content created by the AI system
- All collaboration data: Records of people you’ve shared data with and permissions you’ve granted
- Account information: Your name, email address, and other account details
- Activity history: Login history, usage logs, and activity records associated with your account
2.2 Professional User Specific Deletions
For Professional Users, deletion also includes:
- Professional credentials and licensing information
- Client collaboration records and invitations
- All access permissions to client accounts
2.3 What Is Not Deleted
The following information may be retained as legally required:
- Payment records: Transaction history for tax and accounting compliance (retained for 7 years as required by law)
- Aggregated analytics: Anonymous, non-identifiable usage statistics that cannot be traced back to you
- Legal hold data: Information subject to legal preservation requirements (you will be notified if this applies)
3. How Data Deletion Works
3.1 Deletion Process
To delete your data:
- Log in to your Legacy Keeper account
- Navigate to Account Settings
- Select “Data Management” or “Delete Account”
- Review the deletion warnings and information
- Export any data you wish to keep (optional but strongly recommended)
- Confirm your intention to permanently delete your data
- Verify your identity (may require password re-entry)
- Click the final “Delete All Data” button
3.2 Immediate and Permanent Deletion
Once you confirm deletion, all of your data is immediately and permanently removed from Legacy Keeper’s systems. This happens in real-time – your data is deleted the moment you confirm the action. We do not retain backups, copies, or archives of your deleted data.
3.3 No Waiting Period
Unlike some services that impose a waiting period before deletion, Legacy Keeper deletes your data immediately. There is no grace period, recovery window, or delay. Once deleted, your data is gone forever.
3.4 Confirmation Email
After deletion, you will receive a confirmation email at your registered email address confirming that your data has been permanently deleted. This email serves as documentation of the deletion.
4. Critical Warnings About Data Deletion
4.1 Deletion Is Permanent and Irreversible
THIS IS THE MOST IMPORTANT THING TO UNDERSTAND: Once you delete your data, it is gone forever. There is absolutely no way to recover it. Legacy Keeper cannot restore your data, and no technical support or recovery service can retrieve it. Even if you immediately regret the deletion, your data cannot be recovered.
4.2 No Backups Are Retained
We do not keep backup copies of deleted data. Some online services retain backups for 30, 60, or 90 days after deletion. Legacy Keeper does not. When you delete your data, it is immediately purged from all systems, including backup systems.
4.3 Export Your Data First
Before deleting your data, we strongly urge you to export all information you may need in the future. Legacy Keeper provides data export functionality that allows you to download all of your estate planning information, documents, and files. Once you delete your data, you will not be able to export it.
4.4 Impact on Shared Access
If you have shared your data with others (professional advisors, family members), deleting your data has the following effects:
- All access is immediately revoked: Anyone you’ve shared with will immediately lose access to your data
- No copies remain: Authorized users do not receive copies of your data when you delete it
- Collaboration ends: All collaboration agreements and permissions are terminated
Important for Professional Users: If you are a Professional User with access to client data, deleting your account removes your access to all client accounts. However, it does NOT delete your clients’ data – their information remains in their own accounts.
4.5 Critical: Data Already Copied by Collaborators Cannot Be Retracted
IMPORTANT: If you have shared your data with professional advisors, family members, or other users, they may have already downloaded, exported, copied, or otherwise saved your information. Revoking their access or deleting your account only removes their ability to access your data through Legacy Keeper – it does NOT delete any copies they have already made.
When you share data with others through Legacy Keeper:
- They can export or download information: Professional advisors and other authorized users have the ability to export, download, or copy data you’ve shared with them
- These copies remain with them: Any data they have already saved, printed, or copied remains in their possession even after you revoke access
- You cannot retract downloaded data: Once someone has made a copy of your data, you cannot force them to delete it
- Professional obligations may apply: Professional advisors may be required by law or professional standards to retain copies of client information even after your collaboration ends
- Legacy Keeper cannot control external copies: We have no ability to delete, retract, or control data that others have downloaded or copied from the platform
By sharing your data with others through Legacy Keeper, you acknowledge and accept that:
- They may retain copies of your information even after access is revoked
- You are responsible for understanding the implications of sharing sensitive information
- You should only share data with people and professionals you trust
- Legacy Keeper is not responsible for how others use data you have shared with them
- Deleting your account does not delete copies held by your collaborators
If you are concerned about who has copies of your data, you should contact those individuals directly to discuss data retention and deletion. This is particularly important if you have worked with professional advisors who may have legal or ethical obligations regarding client data retention.
4.6 You Are Responsible for Backups
You are solely responsible for maintaining your own backups of any information you want to preserve. Legacy Keeper’s data export tools are provided to help you do this, but it is your responsibility to export and save your data before deletion.
5. Special Circumstances
5.1 Active Subscriptions
If you have an active paid subscription when you delete your data:
- Your subscription will be cancelled immediately
- You will not be charged for any future billing periods
- You are not entitled to a refund for the current billing period
- Any unused subscription time is forfeited
5.2 Legal Obligations and Court Orders
In rare circumstances, we may be legally prohibited from deleting certain data, such as when:
- Your data is subject to a legal hold or preservation order
- A court has ordered us to retain your information
- We are required by law to retain certain records (such as payment transaction history)
- Your data is needed for ongoing litigation or regulatory investigations
If any of these circumstances apply to your data, we will:
- Notify you immediately via email
- Explain which data must be retained and why
- Retain only the minimum data necessary to comply with legal requirements
- Delete the retained data as soon as the legal obligation ends
5.3 Professional Users with Active Client Relationships
If you are a Professional User with active access to client accounts:
- Deleting your account immediately terminates all client access permissions
- Your clients will be notified that you no longer have access to their data
- Your clients’ data remains intact in their own accounts
- You should inform your clients before deleting your account to avoid service disruption
5.4 Deceased User Accounts
If a Legacy Keeper user passes away, authorized representatives (such as executors or next of kin) may request account access or data deletion by contacting us at admin@legacykeeper.app with appropriate legal documentation. We will require proof of death and legal authority before taking any action.
6. Alternatives to Full Deletion
6.1 Partial Data Deletion
If you don’t want to delete all of your data, you can selectively delete specific information from within your account. You can remove individual documents, sections of your estate plan, or other specific data without deleting your entire account.
6.2 Account Deactivation
If you want to stop using Legacy Keeper temporarily but preserve your data, you can deactivate your account instead of deleting it. Deactivation:
- Prevents anyone from accessing your account
- Preserves all of your data
- Can be reversed at any time by reactivating your account
- Does not cancel your subscription (you must cancel separately)
6.3 Data Export Without Deletion
You can export your data at any time without deleting it. This allows you to maintain a personal backup while continuing to use Legacy Keeper. We recommend regularly exporting your data as a best practice.
6.4 Revoke Access Permissions
If you’re concerned about who has access to your data, you can revoke access permissions for specific users without deleting your account or data. This allows you to maintain control over your information while keeping it in Legacy Keeper.
7. Your Acknowledgment and Agreement
By using Legacy Keeper’s data deletion features, you acknowledge and agree that:
- You have read and understood this Data Deletion Agreement
- You understand that data deletion is permanent and irreversible
- You understand that Legacy Keeper does not retain backups of deleted data
- You are solely responsible for exporting and backing up any data you want to preserve
- You will not hold Legacy Keeper liable for any consequences of data deletion
- You understand the impact of deletion on shared access and collaboration
- You waive any claims against Legacy Keeper related to deleted data
- You accept full responsibility for your decision to delete data
8. Limitation of Liability for Deleted Data
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LEGACY KEEPER AND TRACTION TECHNOLOGIES INC. SHALL NOT BE LIABLE FOR ANY LOSS, DAMAGE, OR CONSEQUENCES RESULTING FROM DATA DELETION, INCLUDING BUT NOT LIMITED TO:
- Loss of important estate planning information or documents
- Inability to recover deleted data
- Disruption to professional relationships or services
- Financial losses or legal consequences resulting from lost data
- Emotional distress or personal hardship caused by data loss
- Any other direct, indirect, incidental, or consequential damages
You expressly assume all risk associated with deleting your data and agree to hold Legacy Keeper harmless for any consequences of such deletion.

9.2 After Deletion
Please understand that once data is deleted, our support team cannot help you recover it. We will not respond to requests to restore deleted data because restoration is technically impossible.

10. Changes to This Agreement
We may update this Data Deletion Agreement from time to time. Any changes will be posted on our website with an updated effective date. Material changes will be communicated via email at least 30 days before taking effect. Your continued use of the deletion features after changes take effect constitutes acceptance of the updated Agreement.
FINAL REMINDER
Data deletion is permanent, immediate, and irreversible. Once you delete your data, it is gone forever and cannot be recovered by anyone, including Legacy Keeper. Please export any information you wish to keep before proceeding with deletion.
